Welcome to CarBike4u. Please read these Terms of Service ("Terms") carefully as they contain important information about your legal rights, remedies, and obligations. By accessing or using the CarBike4u platform, you agree to comply with and be bound by these Terms.

1. Acceptance of Terms

By accessing or using our website, mobile applications, or any other features, technologies, or functionalities offered by CarBike4u (collectively,the "Platform"), you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform.

2. Changes to Terms

We may modify these Terms at any time. If we make changes, we will provide notice of such changes, such as by sending an email notification, providing notice through the Platform, or updating the "Last Updated" date at the beginning of these Terms. Your continued use of the Platform following notification of changes will constitute your acceptance of such changes. If you do not agree to any modified terms, you must stop using the Platform.

3. Platform Description

CarBike4u is an online platform that connects car buyers with car sellers, including individuals and dealerships. We provide information about new and used cars, including prices, specifications, features, reviews, and comparisons to help users make informed decisions. CarBike4u does not own or sell cars directly and is not a party to any transaction between buyers and sellers.

4. User Accounts

To access certain features of the Platform, you may need to register for an account. When you register, you agree to provide accurate, current, and complete information and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately if you suspect any unauthorized use of your account.

5. User Content

Our Platform may allow you to post, upload, publish, submit, or transmit content, including but not limited to text, photos, videos, reviews, and comments ("User Content"). By making available any User Content on or through the Platform, you grant to CarBike4u a worldwide, irrevocable, perpetual, non-exclusive, transferable, royalty-free license, with the right to sublicense, to use, copy, adapt, modify, distribute, license, sell, transfer, publicly display, publicly perform, transmit, stream, broadcast, and otherwise exploit such User Content on, through, or by means of the Platform.

You are solely responsible for all User Content that you make available on or through the Platform. You represent and warrant that: (i) you either are the sole and exclusive owner of all User Content or you have all rights, licenses, consents, and releases necessary to grant CarBike4u the rights in such User Content as contemplated under these Terms; and (ii) neither the User Content nor your posting, uploading, publication, submission, or transmittal of the User Content or CarBike4u's use of the User Content will infringe, misappropriate, or violate a third party's patent, copyright, trademark, trade secret, moral rights, or other intellectual property rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation.

6. Prohibited Activities

You agree not to:

• Use the Platform for any illegal purpose or in violation of any local, state, national, or international law.
• Violate or encourage others to violate the rights of third parties, including intellectual property rights.
• Post, upload, or distribute any content that is unlawful, defamatory, libelous, inaccurate, or that a reasonable person could deem to be objectionable, profane, indecent, pornographic, harassing, threatening, hateful, or otherwise inappropriate.
• Interfere with security-related features of the Platform, including by disabling or circumventing features that prevent or limit use or copying of any content.
• Use the Platform to transmit malware, spyware, adware, or any other malicious code or program.
• Attempt to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Platform.
• Collect, harvest, or scrape any information from the Platform, including user accounts or data.
• Impersonate another person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.

7. Intellectual Property

The Platform and its original content, features, and functionality are owned by CarBike4u and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You may not copy, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Platform, except as incidental to normal web browsing or as expressly permitted by these Terms.

8. Third-Party Links and Content

The Platform may contain links to third-party websites or resources and third-party content, including advertisements and promotions. We provide these links and content only as a convenience and are not responsible for the content, products, or services on or available from those websites or resources. You acknowledge sole responsibility for and assume all risk arising from your use of any third-party websites or resources.

9. Termination

We may terminate or suspend your access to the Platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Platform will immediately cease.

10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE PLATFORM OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CarBike4u, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE PLATFORM.

12. Indemnification

You agree to defend, indemnify, and hold harmless CarBike4u, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees and costs, arising out of or in any way connected with your access to or use of the Platform or your violation of these Terms.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India for the resolution of any disputes arising out of or relating to these Terms or your use of the Platform.

14. Entire Agreement

These Terms constitute the entire agreement between you and CarBike4u regarding the use of the Platform, superseding any prior agreements between you and CarBike4u relating to your use of the Platform.
